These Terms and Conditions apply to your use of julianclairetoronto.com, to all products and services offered by Julian & Claire Toronto, and to all agreements entered into between the customer and Julian & Claire Toronto.

Julian & Claire Toronto is a trading name operated by L&D Ecommerce Limited.

By visiting our website, creating an account, submitting an order or purchasing a product, you confirm that you have read and agreed to these Terms and Conditions, together with our Shipping Policy, Return and Refund Policy and Privacy Policy.

If you do not agree to these terms, you should not use the website or place an order.

 


 

1. Definitions

In these Terms and Conditions, the following definitions apply:

Any terms proposed by the customer will not apply unless Julian & Claire Toronto has expressly accepted them in writing.

If any part of these Terms and Conditions conflicts with a mandatory consumer protection law that cannot legally be excluded, the mandatory legal provision will apply to the extent of that conflict.

 


 

3. Eligibility to Purchase

5. Prices, Promotions and Taxes

Prices displayed on the website are generally shown in Canadian dollars unless otherwise stated.

Applicable sales taxes will be displayed or calculated during checkout where required.

We may change product prices at any time before an order is accepted. A price change will not affect an order that has already been accepted by us.

We make reasonable efforts to ensure that prices and promotions are accurate. If an obvious pricing, typographical or technical error occurs, we may contact the customer before accepting or fulfilling the order.

In such circumstances, the customer may be given the opportunity to proceed at the correct price or cancel the affected item or order.

Discount codes, promotional offers and bundle discounts:

  • Have no cash value;

6. Order Submission and Acceptance

Submitting an order through the website constitutes an offer by the customer to purchase the selected products.

An automatic order confirmation confirms that we have received the order. It does not necessarily mean that the order has been finally accepted or shipped.

An order is accepted when:

We reserve the right to decline, cancel or place an order on hold before shipment where reasonably necessary, including when:

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

 


 

7. Order Verification and Fraud Prevention

To protect customers and Julian & Claire Toronto against fraud, unauthorized transactions and chargebacks, we may conduct additional checks before releasing an order.

We may ask the customer to confirm information including:

  • Billing address;
  • Shipping address;
  • Postal code;
  • Email address;
  • Telephone number;
  • Confirmation that the customer placed and authorized the order.

An order may remain on hold while verification is pending.

We will never ask the customer to email a complete payment-card number, card security code or online banking password.

If the customer does not provide reasonably requested verification, we may cancel the order and refund any eligible amount to the original payment method.

  • Shop Pay;

Payment must be successfully authorized before an order can be fulfilled.

Payments may be processed by third-party payment providers. Use of a payment provider may also be subject to that provider’s terms and privacy practices.

The customer is responsible for ensuring that:

  • The selected payment method is valid;
  • Sufficient funds or credit are available;
  • The billing information is complete and accurate;
  • The customer is authorized to use the payment method.

 


 

9. Cancellations and Order Changes

Customers should contact our Customer Care Team as soon as possible if they wish to cancel or change an order.

Because processing may begin shortly after an order is submitted, we cannot guarantee that an order can be changed or cancelled.

Once an order has entered fulfilment or has been shipped, it can no longer be cancelled and must be handled under our Return and Refund Policy.

Any mandatory cancellation rights that cannot legally be excluded remain unaffected.

 


 

10. Processing and Delivery

Orders are normally processed within 1 to 3 business days.

The estimated total delivery time within Canada is normally 9 to 14 business days.

All delivery times are estimates and are not guaranteed.

Delivery may take longer due to circumstances including:

  • Busy sales periods;
  • Public holidays;
  • Severe weather;
  • Carrier disruptions;
  • Customs or security inspections;
  • Labour disputes;
  • Incorrect or incomplete customer information;
  • Remote delivery locations;
  • Other circumstances outside our reasonable control.

A delay within the carrier network does not automatically mean that a parcel is lost.

11. Customer Responsibility for Delivery Information

The customer is responsible for providing complete and accurate shipping information, including:

  • The recipient’s full name;
  • Street name and house or unit number;
  • Apartment, suite or buzzer number where applicable;
  • City and province;
  • Postal code;
  • Email address;
  • Telephone number.

Customers must review their order confirmation and notify us as soon as possible if any information is incorrect.

We cannot guarantee that an address can be changed after the order has entered processing or fulfilment.

To the extent permitted by applicable law, Julian & Claire Toronto is not responsible for delivery failure caused by inaccurate, incomplete or outdated information supplied by the customer.

 


 

12. Tracking, Delivery Attempts and Pickup Locations

Where available, tracking information will be sent after an order has shipped.

The customer is responsible for monitoring the tracking status and responding promptly to:

  • Delivery notifications;
  • Attempted-delivery notices;
  • Requests from the carrier;
  • Pickup instructions;
  • Address or access issues.

If the customer is unavailable at the time of delivery, the carrier may make another delivery attempt, leave the parcel in an authorized safe place, deliver it to a parcel locker or transfer it to an official pickup location.

Transfer to an authorized pickup location following an unsuccessful delivery attempt forms part of the normal delivery process and does not, by itself, constitute non-delivery.

The customer must collect the parcel within the timeframe specified by the carrier.

If the customer does not collect the parcel, refuses delivery or fails to cooperate with reasonable carrier instructions, the parcel may be returned to sender.

Any refund or reshipment will only be assessed after the return status has been verified and will be subject to our Shipping Policy and Return and Refund Policy.

 


 

13. Fulfilment Partners and International Shipping Routes

Julian & Claire Toronto may use suppliers, warehouses, fulfilment partners and logistics providers located in Canada or other countries to process and deliver orders.

Products may therefore be shipped through an international logistics route or directly from an overseas fulfilment facility.

The use of a third-party supplier, warehouse, fulfilment partner or carrier does not change the contractual relationship between Julian & Claire Toronto and the customer.

Julian & Claire Toronto remains the customer’s point of contact for order-related questions, subject to these Terms and Conditions and applicable law.

 


 

14. Import Duties, Taxes and Additional Charges

Orders placed for delivery within Canada will be charged according to the prices, taxes and other amounts disclosed during checkout.

Customers will not be charged undisclosed mandatory fees by Julian & Claire Toronto after checkout.

If an international delivery outside Canada is separately agreed, the recipient may be responsible for:

  • Import duties;
  • Customs charges;
  • Local taxes;
  • Brokerage fees;
  • Other charges imposed by the destination country or carrier.

Unless expressly stated otherwise before purchase, these international charges are not included in the product price and must be paid by the recipient directly to the relevant authority or carrier.

Refusal to pay applicable international charges may cause the parcel to be returned. Verified non-recoverable shipping, customs, return or handling costs may be deducted from an eligible refund where permitted by applicable law.

 


 

15. Returns, Exchanges and Refunds

Julian & Claire Toronto offers a 30-day return period, subject to the eligibility requirements stated in our Return and Refund Policy.

Unless otherwise required by applicable law:

  • A return request must be submitted within 30 calendar days after delivery;
  • The return must be approved before the item is shipped;
  • The item must be unused, unworn, unwashed and unaltered;
  • All original tags must remain attached;
  • Original packaging, accessories and documents must be included;
  • The customer must follow the return instructions provided by our Customer Care Team;
  • The customer is responsible for ordinary return shipping costs for change-of-mind, sizing, fit, style or colour-preference returns.

Customers must not send a return to the original shipping address or any other address that has not been authorized by our Customer Care Team.

Receiving a returned parcel does not automatically mean that the return has been approved. Returned items will be inspected before a refund or exchange is processed.

Items that show wear, washing, alteration, damage, stains, odours, missing tags, missing accessories or other loss of value may be refused or may qualify only for a reduced refund, where permitted by applicable law.

16. Incorrect Size, Fit or Colour Preference

The customer is responsible for reviewing the product description, measurements, size chart and available product options before submitting an order.

A product being too large, too small, looser, tighter or otherwise fitting differently from the customer’s preference does not, by itself, mean that the product is defective.

Minor colour differences caused by photography, lighting, screen settings, fabric or production batches do not automatically mean that an item is defective or incorrectly supplied.

Returns and exchanges based on size, fit, style or colour preference remain subject to the standard return conditions and customer-paid return shipping costs.

 


 

17. Damaged, Defective or Incorrect Products

If a customer believes that a product is damaged, materially defective or incorrectly supplied, the customer should contact our Customer Care Team as soon as reasonably possible.

We may request reasonable evidence to investigate the claim, including:

  • Photographs of the complete product;
  • Close-up photographs of the issue;
  • A photograph of the product label;
  • A photograph of the outer packaging and shipping label;
  • A short video where the issue cannot be demonstrated clearly in photographs.

The customer must not wear, wash, alter, repair or dispose of the product while the claim is under review, unless doing so is reasonably necessary for safety or we have provided different instructions.

Depending on the circumstances and applicable law, an appropriate solution may include:

  • Repair where appropriate;
  • Replacement;
  • Reshipment of the correct product;
  • Partial refund;
  • Full refund;
  • Store credit, where accepted by the customer;
  • Return of the item at our expense where required.

A loose thread, removable crease, minor packaging damage, slight measurement variation, natural material variation or reasonable colour difference does not necessarily mean that an item is defective.

Nothing in these Terms and Conditions excludes any mandatory statutory warranty or other consumer right relating to defective, unsafe, incorrectly described or incorrectly supplied products.

 


 

18. Refund Processing

Approved refunds will normally be issued to the original payment method.

After an eligible return has been received, inspected and approved, please allow approximately 5 to 7 business days for us to process the refund.

Additional processing time may be required by the customer’s bank, card issuer or payment provider.

Unless otherwise required by law, the following costs are generally non-refundable:

  • Original premium or expedited delivery costs;
  • Customer-paid return shipping costs;
  • Customs duties or import charges;
  • Return-to-sender charges caused by the customer;
  • Costs resulting from an incorrect or unauthorized return address;
  • Costs resulting from failure to follow the return instructions.

Discounts, bundle offers and promotional reductions may be recalculated when only part of an order is returned.

If the retained products no longer qualify for the original promotion, the refund may be adjusted to reflect the correct price of the retained products, where permitted by applicable law.

 


 

19. Non-Returnable and Final-Sale Products

Certain products may be non-returnable for hygiene, health, safety or personalization reasons, except where they are defective or incorrectly supplied.

These products may include:

  • Underwear and intimate apparel;
  • Swimwear after removal of a hygiene seal;
  • Earrings or pierced jewellery;
  • Personal-care or hygiene products;
  • Personalized, customized or made-to-order products;
  • Gift cards;
  • Products clearly marked as final sale or non-returnable before purchase.

Final-sale or non-returnable status will be displayed on the relevant product page where applicable.

A final-sale designation does not exclude mandatory rights relating to defective, unsafe or incorrectly supplied products.

 


 

20. Product Safety and Recalls

Customers must use and care for products according to any instructions supplied with the product.

If a customer becomes aware of a potential safety problem, the customer should stop using the product and contact Julian & Claire Toronto promptly.

Customers agree to cooperate reasonably with any applicable recall, safety investigation or corrective action.

 


 

21. Delivery and Return Disputes

Starting a chargeback or payment dispute does not automatically establish that:

  • An order was not delivered;
  • A returned item was eligible for a refund;
  • The customer followed the return instructions;
  • A refund or replacement is legally due.

In connection with a delivery or payment dispute, Julian & Claire Toronto may provide relevant evidence to the payment provider, including:

  • Order confirmation details;
  • The policies applicable on the purchase date;
  • Payment and fraud-screening information;
  • Shipping and tracking information;
  • Delivery-attempt records;
  • Pickup-location notices;
  • Proof of delivery;
  • Address information supplied by the customer;
  • Customer communications;
  • Return instructions and tracking;
  • Warehouse or inspection records;
  • Evidence of a refund, replacement or proposed resolution.

Nothing in this section prevents a customer from exercising any lawful statutory or contractual right.

 


 

22. Customer Accounts

Where customer accounts are available, the customer is responsible for:

  • Providing accurate account information;
  • Keeping login details confidential;
  • Restricting access to the account and device;
  • Notifying us promptly of suspected unauthorized access.

Where reasonably possible, we will take appropriate steps to reduce the effect of the event and continue or resume performance.
